Terms and Conditions of Service

  1. General Provisions
    1. These general terms and conditions of sale (hereinafter the ‘General Terms and Conditions’) apply to all distance sales of RUDY PROFUMI SRL products (hereinafter the ‘Products’ or ‘Product’) made via the website www.rudyprofumi.it (hereinafter the ‘Website’).
    2. The distance selling services described in these General Terms and Conditions are available only to consumers (hereinafter referred to as ‘Customers’ or ‘Customer’), namely natural persons acting for purposes unrelated to their commercial, business, craft or professional activities, who are over 18 years of age (or, if under 18, duly authorised by their legal representative).
    3. The language used to conclude any contract via this Website is Italian or English.
    4. Customers are required to read these General Terms and Conditions carefully; they have been made available on the Website to enable Customers to view, save and reproduce them.
    5. Each purchase is governed by the General Terms and Conditions available on the Website at the time the Customer completes the order submission process. Contracts with Customers will be stored by RUDY PROFUMI SRL and made accessible to Customers via the Website through their account.
  2. Identification of the seller
    1. The seller is RUDY PROFUMI SRL, with its registered office at Via Einstein 4 (20090) ASSAGO - MILAN, VAT No. 08000970155 – certified email address: pec@pec.rudyprofumi.com
  3. Information on products and their availability
    1. Information on the Products, together with their product codes, is available on the Website.
    2. The Website does not contain all of RUDY PROFUMI SRL’s Products. The Products available on the Website are a selection of items. The images of the Products displayed on the Website may not correspond to their actual appearance.
    3. All Products are subject to availability. RUDY PROFUMI SRL reserves the right at any time to change the quantity limits and/or types of Products available online via the Website. The style, designs and colours of the Products described on the Website may be changed without notice. During the checkout process, an automated response will inform the Customer if the order cannot be fulfilled due to the unavailability of the Product ordered.
    4. Some products may be sold on a pre-order basis. This means that the products are made to order and production will take approximately six weeks.
  4. Price
    1. The prices of the Products are shown on the Website in euros and include VAT, but do not include any taxes, duties or levies applicable in the country of destination of the Products, where this is other than Italy. These costs, which vary from country to country, are to be borne by the Customer, who is responsible for checking the amount with the relevant customs authorities. Delivery charges are added to the price of the Products and are shown separately on the order form.
    2. The information displayed on the Website does not constitute an offer by RUDY PROFUMI SRL.
  5. Purchases
    1. Before submitting an order proposal, the Customer must ensure that they have read and understood all the instructions provided during the purchase process, together with the General Terms and Conditions currently available on the Website, as they will be bound by these once the contract has been concluded.
    2. To purchase a Product, the Customer must complete an order form and submit it to RUDY PROFUMI SRL via the Website. The Customer must add the Product to their basket and, after reading and accepting the General Terms and Conditions, as well as having read the privacy policy, must select the desired payment method and choose the order option.
    3. The Customer may correct any errors in the details they have entered before submitting the order form, by following the procedure set out on the Website. In particular, they may amend the quantity of Products they intend to purchase by adding or removing one or more Products from their shopping basket.
    4. By submitting an order proposal to RUDY PROFUMI SRL, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept the General Terms and Conditions.
    5. Without prejudice to the provisions of the privacy policy regarding the use of personal data, the order proposal and the Customer’s data relating to that order proposal may be retained by RUDY PROFUMI SRL for the period provided for by applicable legislation.
  6. Payment methods
    1. Customers may pay for Products and the associated delivery charges using the payment methods expressly indicated on the Website.
    2. Should it not be possible, for any reason, to debit the amounts owed by the Customer, the transaction will be terminated and the sale cancelled.
  7. Conclusion of the contract
    1. The contract between RUDY PROFUMI SRL and the Customer is deemed to have been concluded when the Customer receives confirmation from RUDY PROFUMI SRL, by email, that their order request, submitted via the procedure indicated on the Website, has been successfully completed.
  8. Shipping and Delivery
    1. Products purchased on the Website will be delivered to the address specified in the order. Upon delivery, the Customer or an adult authorised by the Customer will be required to sign for the goods. RUDY PROFUMI SRL cannot deliver to PO boxes.
    2. Dispatch will only take place once payment has been received by RUDY PROFUMI SRL.
    3. For each order, RUDY PROFUMI SRL will make the necessary entry in its sales ledger. An invoice will only be issued at the Customer’s express request at the time of ordering.
    4. Delivery charges are payable by the Customer and are shown separately on the order form.
    5. All purchases will be delivered by a courier chosen by RUDY PROFUMI SRL (hereinafter the ‘Courier’), from Monday to Saturday, excluding Sundays and local or national public holidays, starting from the day after the goods are ready for dispatch. RUDY PROFUMI SRL is not liable for delays that are unforeseeable and/or attributable exclusively to the Courier.
    6. Unless events of force majeure or unforeseeable circumstances occur, the Products must be delivered within 30 (thirty) days of the date of conclusion of the contract referred to in paragraph 7 above.
    7. In the event that, following notification by RUDY PROFUMI SRL of a delay in delivery beyond the deadline specified in clause 8.6, the Customer wishes to cancel the order, any amount already paid by the Customer will be refunded as soon as possible, and in any event no later than fourteen days from the date of receipt of the Customer’s notice of cancellation of the order, with the exception of personalised Products, which are subject to Paragraph 10 below.
    8. The Customer or their representative must be present at the delivery address specified in the order for the Products and, upon delivery by the courier, is required to check: (i) that the number of items delivered corresponds to that indicated on the delivery note and (ii) that the packaging and its seals are intact, undamaged, not wet or otherwise tampered with. Any damage to the packaging and/or the Product visible on delivery, or discrepancies in the number of parcels or in the documentation, must be immediately noted in writing on the courier’s delivery note. Once the courier’s document has been signed without any objection by the Customer, the Customer may not raise any objection regarding the external condition of the delivered parcel.
    9. RUDY PROFUMI SRL will send the Customer a confirmation email once the Products have been dispatched.
  9. Packaging
    1. Products purchased on the Website are delivered in the standard packaging normally used by RUDY PROFUMI SRL.
  10. Personalised products
    1. Pursuant to Article 59 of Legislative Decree No. 206/2005 (Consumer Code), the right of withdrawal, which would otherwise apply, does not apply to orders for personalised products, such as, for example, those with the Customer’s initials engraved on the product or pre-ordered products. The Customer is aware that the images on the Website do not necessarily correspond to reality: the images and photographs of the engraving may not reflect the actual appearance of the final product.
  11. Right of withdrawal
    1. RUDY PROFUMI SRL strives to ensure the complete satisfaction of its customers. The customer has the right to withdraw from the contract without giving any reason, by returning the products purchased on the website within fourteen days of the date of receipt of the products, in accordance with Article 52 of the Consumer Code. This applies to all products other than personalised items, which are subject to Paragraph 10.
    2. To exercise the right of withdrawal, the Customer must go to the ‘Orders’ section of their account and click on ‘Return’ or ‘Refund’, depending on the order’s fulfilment status.
      Alternatively, send an email to shop@rudyprofumi.com, stating: your intention to exercise your right of withdrawal; the products for which you wish to exercise this right; the order number; and, if you paid for the products by bank transfer, your bank details for the refund.
    3. Upon exercise of the right of withdrawal, RUDY PROFUMI SRL will refund the full price of the Products, provided that they are returned by the Customer in good condition, unused and undamaged, in their original packaging. RUDY PROFUMI SRL reserves the right to refuse returns of Products that do not meet these requirements.
    4. Refunds will be made via the same payment method used for the purchase.
    5. The cost of returning the Products shall be borne by the Customer. Any costs incurred by the Customer in returning the Products are non-refundable.
    6. The Customer must return the Products to the seller or to a third party authorised by the seller to receive them, without undue delay and in any event within fourteen days of the date on which they notified the seller of their decision to withdraw from the contract. The deadline is met if the Customer dispatches the goods before the expiry of the fourteen-day period.
    7. RUDY PROFUMI SRL undertakes to refund the Customer within fourteen days of receiving the Customer’s notification of order cancellation, but, pursuant to Article 56 of the Consumer Code, reserves the right to withhold the refund until it has received the goods, or until the Customer has provided evidence that the goods have been returned, whichever occurs first.
    8. RUDY PROFUMI SRL will send a notification email once the refund has been processed.
    9. We recommend returning the Products by courier, insuring the full value of the item and using a trackable delivery service. RUDY PROFUMI SRL cannot be held liable for the refund or compensation of Products that have been returned but not received by RUDY PROFUMI SRL due to loss, theft or damage not attributable to RUDY PROFUMI SRL.
  12. Product Defects
    1. Should a Product sold by RUDY PROFUMI SRL have manufacturing defects or a lack of conformity, the Customer must contact Customer Services as soon as possible by email at shop@rudyprofumi.com and, in any event, report the defect within two months of discovery. No formal notification is required if the seller has acknowledged the existence of the defect or has concealed it.
    2. In the event of a lack of conformity, the Customer is entitled to have the Product repaired or replaced. A price reduction and termination of the sales contract are, however, applicable remedies (a) where the seller has failed to complete the repair or replacement, or where the seller has refused to restore the goods to conformity; (b) where a lack of conformity persists despite the seller having attempted to restore the goods to conformity; (c) where the lack of conformity is so serious as to justify an immediate price reduction or termination of the sales contract; or (d) where the seller has stated that they will not restore the goods to conformity or has failed to do so within a reasonable time, or without significant inconvenience to the Customer. If the lack of conformity is minor (the burden of proof resting with the seller), the Customer is not entitled to terminate the contract; however, they may refuse to pay the price or part thereof until the seller has remedied the lack of conformity (Articles 135-bis et seq. of the Consumer Code).
  13. Errors or inaccuracies
    1. RUDY PROFUMI SRL undertakes to provide up-to-date information in the sections of the Website relating to the description and/or sale of the Products. However, RUDY PROFUMI SRL cannot guarantee that the Website is free from errors. The Website in question may contain typographical errors, inaccuracies or omissions, for example relating to the price or availability of a Product or to the information provided about the Product. RUDY PROFUMI SRL reserves the right to correct such errors, inaccuracies or omissions, as well as the right to amend or update the information at any time, without prior notice.
  14. Guarantee of authenticity and intellectual property rights
    1. RUDY PROFUMI SRL guarantees the authenticity of all Products purchased on the Website. Products bearing the RUDY PROFUMI SRL trademark are MADE IN ITALY.
    2. The RUDY PROFUMI SRL trademark, together with all figurative and non-figurative trademarks and service marks featured on the Products, on the related accessories and/or packaging, whether registered or not, together with all illustrations and images protected by copyright, and more generally all intellectual property rights relating to the Products, are and remain the exclusive property of RUDY PROFUMI SRL.
  15. Governing Law and Competent Court
    1. These General Terms and Conditions are governed by Italian law. In matters not expressly provided for herein, Legislative Decree No. 206 of 6 September 2005, as subsequently amended, the “Consumer Code”, and Legislative Decree No. 70 of 9 April 2003, the “E-commerce Decree”, shall apply.
    2. Any dispute arising from the interpretation, validity and/or performance of these General Terms and Conditions shall be subject to the exclusive territorial jurisdiction of the court of the Customer’s place of residence or domicile, provided that such place is situated within Italian territory.
